Welcome to The Project Jugaad. These Terms and Conditions govern your use of our main website at www.theprojectjugaad.com. They also cover the information, content, forms, pages, materials, and services available on this website.

By accessing, browsing, submitting an inquiry, requesting a quotation, communicating with us, or using this website, you agree to these Terms and Conditions, our Privacy Policy, and any other notices published on this website. If you do not agree with these Terms and Conditions, you should not use this website.

1. About The Project Jugaad

The Project Jugaad provides custom software development and IT-related services. These include web application development, mobile application development, AI-enabled software solutions, graphic design, voice assistant applications, QA and testing, infrastructure support, DevOps, cloud migration, content management, support, and maintenance.

This website shares information about our company, services, experience, portfolio, contact options, and business offerings. However, a separate written proposal, quotation, statement of work, invoice, agreement, email confirmation, or service-specific terms may govern any actual service engagement.

2. Scope of These Terms

These Terms and Conditions apply only to the main website of The Project Jugaad.

In addition, we may operate separate portals, tools, applications, products, or subdomains, including but not limited to Utilities and Furniture Billing. Such portals may have their own Terms and Conditions, Privacy Policy, refund policy, subscription terms, usage rules, or service-specific policies. If you use those separate portals, their respective policies will apply in addition to, or instead of, these Terms wherever applicable.

If these Terms conflict with a signed agreement, approved quotation, invoice, or service-specific terms, the more specific document will apply to that service or transaction.

3. Use of the Website

These Terms and Conditions allow website use only for lawful and genuine purposes.

You may access this website for informational and business communication purposes. However, you must not misuse the website or interfere with its operation.

Do not submit false, misleading, abusive, harmful, unlawful, defamatory, offensive, spam, or unauthorized content. Also, do not attempt to access any website area, server, database, account, network, or connected system without permission.

You must not copy, scrape, crawl, reproduce, reverse engineer, overload, disrupt, test vulnerabilities, inject malicious code, or use automated tools against this website without our prior written permission.

4. Website Content and Information

We provide website content for general information and business communication only. Although we try to keep it accurate and updated, we do not guarantee that all content will remain complete, current, error-free, or suitable for your needs.

The website may describe services, technologies, tools, industries, examples, estimates, graphics, images, icons, and other materials. However, you should not treat this information as technical, business, legal, financial, security, compliance, or professional advice.

You use website information at your own discretion and risk. Therefore, you should contact us for a formal evaluation, quotation, proposal, or service discussion before making a business decision.

5. Service Inquiries, Quotations, and Proposals

These Terms and Conditions do not create a service contract only because you submit an inquiry.

Submitting an inquiry through the website, contact form, email, phone, WhatsApp, or another channel does not create a contract, obligation, partnership, employment relationship, or client engagement.

Any quotation, proposal, timeline, cost estimate, technical suggestion, commercial discussion, or scope shared by us is indicative unless expressly confirmed in writing. Project scope, price, delivery timeline, payment terms, responsibilities, assumptions, exclusions, dependencies, and deliverables must be agreed separately before work begins.

At our discretion, we reserve the right to accept, reject, revise, pause, or withdraw any inquiry, proposal, quotation, or service request at its sole discretion.

6. Client Responsibilities

For any service engagement, the client is responsible for providing accurate, complete, timely, and legally usable information, content, images, documents, credentials, approvals, feedback, access, third-party details, and project requirements.

Any delay, error, missing information, third-party issue, dependency, change in requirement, approval delay, hosting issue, domain issue, payment delay, or lack of cooperation may affect timelines, cost, quality, delivery, support, or project outcome.

Therefore, we will not be responsible for delays, failures, losses, or additional work caused by incomplete information, inaccurate requirements, third-party dependency, client-side delay, or decisions made by the client.

7. Payments, Fees, and Taxes

These Terms and Conditions work with any quotation, invoice, proposal, or written agreement issued by us.

We will share fees, charges, milestones, taxes, renewal costs, maintenance fees, and other applicable costs through a quotation, invoice, proposal, written confirmation, or service terms.

Unless specifically agreed in writing, all payments must be made in advance or according to the agreed milestone schedule. We may pause, delay, withhold, or stop work, delivery, support, access, deployment, or maintenance in case of non-payment, delayed payment, payment dispute, or breach of agreed terms.

Any taxes, government charges, bank charges, payment gateway charges, currency conversion charges, or other transaction-related costs shall be borne by the client unless otherwise agreed in writing.

8. Cancellation, Refund, and Adjustment Policy

These Terms and Conditions explain how we handle cancellations, refunds, and service adjustments.

We may consider cancellation requests only when you submit them in writing before work starts or before we allocate resources. Once planning, communication, design, development, testing, deployment, consultation, support, purchase, configuration, third-party coordination, or any project-related work has started, cancellation may not be accepted.

Fees paid to The Project Jugaad are generally non-refundable once work has started, resources have been allocated, third-party costs have been incurred, or service delivery has begun. However, at our sole discretion, we may offer partial adjustment, service credit, or alternative resolution depending on the nature of the project, work completed, time spent, cost incurred, and written terms agreed with the client.

If we approve any service credit or adjustment, you must use it within 90 days unless we agree otherwise in writing. Third-party costs such as domain, hosting, server, plugin, theme, API, software license, cloud service, payment gateway, content, image, stock asset, tool, subscription, or vendor charges are non-refundable once paid, purchased, renewed, activated, or committed.

Nothing in this section limits any mandatory rights that may be available under applicable law.

9. Project Changes and Additional Work

Any change in scope, feature, design, content, workflow, timeline, integration, platform, third-party dependency, support requirement, or business requirement after approval may be treated as additional work.

Additional work may require revised timelines, additional charges, fresh approval, or a new quotation. The Project Jugaad is not obligated to provide work beyond the agreed scope unless confirmed in writing.

10. Third-Party Services and Dependencies

Our services may involve third-party platforms, tools, vendors, plugins, themes, APIs, payment gateways, hosting providers, domain providers, cloud platforms, email providers, analytics tools, AI platforms, open-source libraries, or external services.

However, we are not responsible for third-party downtime, pricing changes, policy changes, suspension, data loss, service interruption, security incident, compatibility issue, licensing issue, API change, account restriction, billing issue, or any failure caused by third-party services.

Any effort required from The Project Jugaad to coordinate, troubleshoot, communicate, configure, recover, migrate, or support third-party issues may be charged separately as per our applicable rates.

In addition, this website may use Google reCAPTCHA to help protect forms from spam, abuse, and automated misuse.

11. Intellectual Property Rights

These Terms and Conditions protect our content, reusable code, designs, and business materials.

Unless otherwise agreed in writing, all content, design elements, graphics, icons, text, website structure, page layouts, source materials, documentation, concepts, processes, reusable code, frameworks, know-how, business methods, tools, templates, and materials created or owned by The Project Jugaad remain the property of The Project Jugaad.

For client-specific paid work, we may transfer ownership of final deliverables only after we receive full and final payment. However, this transfer excludes pre-existing materials, third-party assets, open-source components, licensed tools, reusable code, internal frameworks, generic modules, and know-how.

The client must ensure that any content, logo, image, brand material, data, document, access, or asset provided to The Project Jugaad is legally owned by the client or properly licensed for use. The client shall be responsible for any claim arising from materials supplied by the client.

12. Portfolio and Promotional Use

Unless you restrict us in writing, we may mention or display completed work, project type, screenshots, logo, brand name, case summary, service category, or non-confidential project information in its portfolio, website, social media, marketing material, proposals, or presentations.

If a project is confidential or subject to non-disclosure obligations, the client must inform The Project Jugaad in writing before project commencement or before sharing confidential material.

13. Confidentiality

The Project Jugaad respects confidential business information shared for project discussion or service delivery. We will take reasonable steps to protect confidential information from unauthorized disclosure.

However, information will not be considered confidential if it is already publicly available, independently developed, lawfully received from another source, required to be disclosed by law, or shared without confidentiality restrictions.

A separate Non-Disclosure Agreement may be executed if required for sensitive projects.

14. Privacy and Data Handling

Your use of this website is also governed by our Privacy Policy. By using this website or submitting information through it, you consent to the collection, use, storage, and handling of information as described in the Privacy Policy.

For project work, clients are responsible for ensuring that any personal data, business data, user data, customer data, or third-party data shared with The Project Jugaad is collected and shared lawfully, with all required permissions, notices, consents, and legal authority.

Therefore, we will not be responsible for unlawful, unauthorized, inaccurate, or non-compliant data supplied by the client.

15. No Guarantee of Specific Results

Our aim is to provide professional and practical services. However, we do not guarantee any specific business result, revenue, ranking, traffic, conversion, sales, profit, funding, approval, platform acceptance, uptime, performance score, search engine position, user growth, or commercial outcome unless expressly agreed in writing.

Results may depend on multiple factors outside our control, including client decisions, third-party platforms, market conditions, user behavior, content quality, hosting environment, budget, competition, marketing effort, technical limitations, and ongoing maintenance.

At our discretion, we reserve the right to block, restrict, report, or take appropriate action against any user, IP address, account, inquiry, or activity that appears suspicious, harmful, abusive, unlawful, or against these Terms.

18. Limitation of Liability

To the maximum extent permitted by applicable law, The Project Jugaad, its owners, team members, employees, consultants, partners, vendors, or affiliates shall not be liable for any indirect, incidental, special, consequential, punitive, business, reputational, technical, financial, data-related, or commercial loss arising from your use of this website or services.

This includes loss of profit, loss of revenue, loss of data, loss of goodwill, business interruption, system failure, security incident, third-party failure, delay, error, incompatibility, or reliance on website information.

If applicable law does not allow full exclusion of liability, our total liability will remain limited. In that case, liability will not exceed the amount the client paid us for the specific service during the three months before the claim, unless the law requires otherwise.

19. Indemnity

You agree to indemnify, defend, and hold harmless The Project Jugaad, its owners, team members, employees, consultants, partners, vendors, and affiliates from and against any claims, losses, damages, liabilities, penalties, costs, or expenses arising from your use of the website, breach of these Terms, misuse of our services, violation of law, infringement of third-party rights, client-supplied materials, or actions taken based on your instructions.

20. Force Majeure

We will not be responsible for delays, failures, interruptions, or losses caused by events beyond our reasonable control. For example, this may include natural disasters, power failures, internet outages, cyberattacks, government actions, strikes, war, pandemic, server failure, third-party disruption, payment gateway issues, hosting issues, cloud outages, or technical failures.
